Terms of Service

Welcome to TickYouOff! These Terms of Service (“Terms”) govern your access to and use of the TickYouOff website at tickyouoff.com and the TickYouOff mobile application (collectively, the “Service”), operated by TickYouOff (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this minimum age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features, you may need to create an account. You can register using Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Content

3.1 Your Content

You retain ownership of the checklists, text, and other content you submit to the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

3.2 Content Responsibilities

You are solely responsible for your User Content. You agree not to submit content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Infringes any patent, trademark, copyright, trade secret, or other intellectual property rights of any party.
  • Contains software viruses or any other code designed to disrupt or damage the Service.
  • Impersonates any person or entity or misrepresents your affiliation with any person or entity.

3.3 Content Moderation

We reserve the right to remove or modify any User Content that violates these Terms or that we find objectionable, without prior notice.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the Service or servers/networks connected to the Service.
  • Use any automated means (bots, scrapers, etc.) to access the Service without our prior written consent.
  • Circumvent any security features or access controls of the Service.
  • Harass, bully, or intimidate other users.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TickYouOff and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

The Service integrates with or relies on third-party services, including:

7. Advertisements

The Service may display advertisements provided by Google AdSense or other advertising networks. We are not responsible for the content of these advertisements or any transactions between you and advertisers.

8. Community Features

The Service allows you to publish checklists to a public marketplace, save checklists to your library, and interact with other users’ content. You agree to use these features responsibly and in accordance with these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting us.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TICKYOUOFF, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless TickYouOff and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TickYouOff operates, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Effective Date” above. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
